Ethical Behavior Problems and/or Ethical Complaints

RATIONALE
For any individual who believes an ethical violation has occurred, or believes they have been injured or victimized, or who knows of any ethical violation by a Certified Substance Abuse Counselor, or any non-certified Counselor-In-Training, the following steps must be taken.
1999-2000 Board Members Statement of Ethics

INITIATION
Any individual with the personal knowledge that any person has violated the Code of Ethics, or any other rules of the North Carolina Substance Abuse Professional Certification Board, or the statute authorizing the work of this Board (GS 90, Article 5C), may file a complaint against that substance abuse professional by submitting a written complaint addressed to: Chairperson of the Ethics Committee.

The letter, signed by the petitioner or informant, is necessary to begin investigation of any alleged event involving counselor wrong-doing. Such a letter is to be sent at once, with a clear and detailed statement of the grievance, knowing that strict confidentiality will be maintained.

PROCEDURE
The complaint shall be in writing, stating the nature of the alleged offense, signed by the complainant, and shall include:

* Name, address, and telephone number of the Complainant (the person who makes the complaint);
* Name, address, and telephone number of the Respondent (the person against whom the complaint is made);
* A statement of the facts which clearly and accurately describes the allegations against that person.

INVESTIGATION
The complaint shall be investigated, as set out in the North Carolina Administrative Code.

PENALTIES TO CERTIFICATION
Certification may be suspended or revoked as a result of:

* Conviction for a Ciminal offense, as stated in the Certification Manual;
* Willfully submitting false information to the Board;
* Commiting an act contrary to the Ethical Standards of the Board.
